The facts
The 87:13 formula has not operated for eight years. The relevant Madhya Pradesh General Administration Department circular was issued on 29 September 2022. Therefore, it could not have affected “all recruitment drives” conducted over the preceding eight years.170
The dispute began after the Kamal Nath-led Congress government increased OBC reservation from 14% to 27% in 2019, leading to litigation over the quota’s constitutional validity. Congress issued notification without thinking through the legal ramifications.171
The formula did not stop recruitment altogether: appointments proceeded against 87% of the advertised vacancies.172
Nor were the 13% posts simply “cancelled.” Separate provisional lists of OBC and unreserved candidates were prepared so that appointments could be made in accordance with the eventual court ruling.173
In January 2025, the Madhya Pradesh High Court upheld the 87:13 arrangement as an interim mechanism allowing recruitment to continue while protecting the claims of both sets of candidates.174
Reports have estimated approximately 10,000 posts across multiple Madhya Pradesh government recruitments as affected by the formula. That is not the same as 1.87 lakh or 4.87 lakh MPPSC posts.175
